Terms of Service and Privacy Policy

We’ve collected some contact information from you, so we can send you your downloads you requested and tell you about webinars and other events we think you’ll find useful.

We’ll send emails, videos and enticements for a week or so after you first download then approximately weekly thereafter. We’ll try hard not to be spammy or annoying.

At all times, there is a functional unsubscribe link at the bottom of our emails. It is automatic and if you unsubscribe, we won’t contact you again.

We also undertake not to give or sell your details to any other organisation, except as described below in the jargon.

OVERVIEW

This Privacy Policy governs the manner in which Small Fish collects, uses, maintains and discloses information collected from users (each, a “User”) of the https://www.smallfish.com.au/ website (“Site”). This privacy policy applies to the Site and all products and services offered by Small Fish such as the https://tradiestoolbox.com.au.

The processing of personal data, such as the name, address, e-mail address, or telephone number of a User shall always be in line with the General Data Protection Regulation (GDPR), and in accordance with the country-specific data protection regulations applicable to Small Fish Business Coaching. By means of this data protection declaration, our enterprise would like to inform the general public of the nature, scope, and purpose of the personal data we collect, use and process. Furthermore, Users are informed, by means of this data protection declaration, of the rights to which they are entitled.

 

1. Personal identification information

We may collect personal identification information from Users in a variety of ways, including, but not limited to,

  • When Users visit our site

  • Place an order
  • Respond to a survey
  • Subscribe to the newsletter
  • And in connection with other activities, services, features or resources we make available on our Site.

Users may be asked for, as appropriate:

Users may, however, visit our Site anonymously. We will collect personal identification information from Users only if they voluntarily submit such information to us. We may collect non-personal identification information about Users whenever they interact with our Site. Non-personal identification information may include:

Our Site may use “cookies” to enhance User experience.

A specific Internet browser can be recognized and identified using the unique cookie ID. User’s web browser places cookies on their hard drive for record-keeping purposes and sometimes to track information about them. Through the use of cookies, Small Fish Business Coaching can provide the users of this website with more user-friendly services that would not be possible without the cookie setting.

By means of a cookie, the information and offers on our website can be optimized with the user in mind. Cookies allow us, as previously mentioned, to recognize our website users. The purpose of this recognition is to make it easier for users to utilize our website. The website user that uses cookies, e.g. does not have to enter access data each time the website is accessed, because this is taken over by the website, and the cookie is thus stored on the user’s computer system. 4. How we use collected information

Small Fish collects and uses Users personal information for the following purposes:

  • To improve customer service – Your information helps us to more effectively respond to your customer service requests and support needs.
  • To personalize user experience – We may use information in the aggregate to understand how our Users as a group use the services and resources provided on our Site.
  • To improve our Site – We continually strive to improve our website offerings based on the information and feedback we receive from you.
  • To process transactions – We may use the information Users provide about themselves when placing an order only to provide service to that order. We do not share this information with outside parties except to the extent necessary to provide the service.
  • To administer content, promotion, survey or other Site feature
  • To send Users information they agreed to receive about topics we think will be of interest to them.
  • To send periodic emails – The email address Users provide for order processing, will only be used to send them information and updates pertaining to their order. It may also be used to respond to their inquiries, and/or other requests or questions. User will also be subscribed to our mailing list, they will receive emails that may include company news, updates, related product or service information, etc. If at any time the User would like to unsubscribe from receiving future emails, we’ve included detailed unsubscribe instructions at the bottom of each email. The User may also contact us via our Site or email support@www.smallfish.com.au to unsubscribe.

 

5. Subscription to our newsletters

On the website of Small Fish Business Coaching, users are given the opportunity to subscribe to our business newsletter. The input mask used for this purpose determines what personal data are transmitted, as well as when the newsletter is ordered from the controller.

Small Fish Business Coaching informs its customers and business partners regularly by means of a newsletter about enterprise offers. The business’ newsletter may only be received by the User if:

  1. The User has a valid e-mail address and
  2. The User registers to receive any communication from the Site, such as Workshops, Webinars, Newsletters and Free Business Tool Opt-ins.

During registration for the newsletter or an opt-in, we also store the IP address of the computer system assigned by the Internet service provider (ISP) and used by the User at the time of the registration, as well as the date and time of the registration. The collection of this data is necessary in order to understand the (possible) misuse of the e-mail address of a User at a later date, and it therefore serves the aim of the legal protection of the controller.

 

6. Newsletter tracking

The newsletter of Small Fish Business Coaching contains so-called tracking pixels. A tracking pixel is a miniature graphic embedded in such e-mails, which are sent in HTML format to enable log file recording and analysis. This allows a statistical analysis of the success or failure of online marketing campaigns. Based on the embedded tracking pixel, Small Fish Business Coaching may see if and when an e-mail was opened by a User, and which links in the e-mail were called up by Users.

Such personal data collected in the tracking pixels contained in the newsletters are stored and analyzed by the controller in order to optimize the shipping of the newsletter, as well as to adapt the content of future newsletters even better to the interests of the User. These personal data will not be passed on to third parties. Users are at any time entitled to revoke the respective separate declaration of consent issued by means of the double-opt-in procedure. After a revocation, these personal data will be deleted by the controller. Small Fish Business Coaching automatically regards a withdrawal from the receipt of the newsletter as a revocation.

7. SMS Messaging

If you have supplied your mobile number, you consent to receive text messages and notifications from us for informational and promotional purposes.. Message frequency may vary based on your interactions with our website. 

Standard message and data rates may apply. If you respond via SMS to one of our system-generated SMS messages, you will be charged for sending the text depending on your mobile service provider and plan.

We do not share your mobile number with third parties unless you give us specific permission to share your number with a specific third party (in the event of a referral opportunity for example – we’ll ask you before we give your number out).

8. Contact possibility via the website

The website of Small Fish Business Coaching contains information that enables a quick electronic contact to our enterprise, as well as direct communication with us, which also includes a general address of the so-called electronic mail (e-mail address). If a User contacts the controller by e-mail or via a contact form, the personal data transmitted by the User are automatically stored. Such personal data transmitted on a voluntary basis by a User to the data controller are stored for the purpose of processing or contacting the User. There is no transfer of this personal data to third parties.

 

9. Posting comments

On our website, we offer you the opportunity to post comments about individual articles. We use a Facebook Comments plugin for all comments on our site. Please refer to the privacy policies of the respective provider for further information. We reserve the rights to delete inappropriate comments or spam.

10. How we protect your information

We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored on our Site.
Sensitive and private data exchange between the Site and its Users happens over an SSL secured communication channel and is encrypted and protected with digital signatures.

 

11. How we accept payments

On this website, the controller has integrated components of Stripe. Stripe is an online payment service provider and is able to process virtual payments through credit cards.

The personal data transmitted to Stripe is usually first name, last name, address, email address, IP address, telephone number, mobile phone number, or other data necessary for payment processing. The processing of the purchase contract also requires such personal data, which are in connection with the respective order.

The transmission of the data is aimed at payment processing and fraud prevention. The controller will transfer personal data to Stripe, in particular, if a legitimate interest in the transmission is given. The personal data exchanged between Stripe and the controller for the processing of the data will be transmitted by Stripe to economic credit agencies. This transmission is intended for identity and creditworthiness checks.

Stripe will, if necessary, pass on personal data to affiliates and service providers or subcontractors to the extent that this is necessary to fulfil contractual obligations or for data to be processed in the order.

The User has the possibility to revoke consent for the handling of personal data at any time from Stripe. A revocation shall not have any effect on personal data which must be processed, used or transmitted in accordance with (contractual) payment processing.

12. Sharing your personal information

We do not sell, trade, or rent Users personal identification information to others. We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and users with our business partners, trusted affiliates and advertisers for the purposes outlined above.

We may use third-party service providers to help us operate our business and the Site or administer activities on our behalf, such as sending out newsletters or surveys. We may share your information with these third parties for those limited purposes provided that you have given us your permission.

Users may find advertising or other content on our Site that link to the sites and services of our partners, suppliers, advertisers, sponsors, licensors and other third parties. When you subscribe to our digital marketing communications the information generated is used for the purpose of compiling our database. We do not (and will not allow any third party to) view or collect any personal information from it.

When you visit certain sections of our website, Google Analytics, the website analytics service provided by Google, Inc (“Google”), will place cookies on your computer’s browser. The information generated by the cookies is transmitted to Google. This information is then used for the purpose of compiling statistical reports to enable us to measure and analyse the number of visits to the site and its pages, the average time spent on the site and the pages viewed. We do not (and will not allow any third party to) use Google Analytics to track or to collect any personal data of visitors to our website. Use of Facebook Components

Our website employs components provided by facebook.com. Facebook is a service of Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA.

Each time our website receives an access request equipped with a Facebook component, the component prompts your browser to download an image of this Facebook component. Through this process, Facebook is informed precisely which page of our website is being
visited.

When you access our site while logged into Facebook, Facebook uses information gathered by this component to identify the precise page you are viewing and associates this information to your personal account on Facebook. Whenever you click on the “Like“ button, for example, or enter a comment, this information is transmitted to your personal account on Facebook and stored there.
